TERMS AND CONDITIONS

These Terms and Conditions apply to the Angling Direct Black Ticket Event & Cyber Weekend promotions:

1. The Black Ticket Event Promotion will begin at 09:00 (GMT) on 1st November 2023 (the “Start Date”) and closes at 23.59 (GMT) on 27th November 2023 (the “End Date”). Discounts will only be valid during this time. Discount cannot be used in conjunction with any other discount or promotion or be applied retrospectively.

2. The Black Ticket Event Promotional Offers are only valid on www.anglingdirect.eu

3. Packaging on some items may be damaged or appear soiled or dirty as some of the promotional items are clearance items

4. As this is a clearance sale, products are sold "as is" and no exchanges or returns will be processed for these clearance items

5. Items included in the Black Ticket Event are only available at the special sale price from our current stocks

6. No stock is to be ordered from supplier to fulfil customer demand

7. Online order processing can take up to 10-14 working days depending on the products ordered

8. All prices are as shown on the site. Discounts have already been calculated and reflected in the ‘Now’ price

9. All purchases are "first come, first serve", there is no guarantee of a successful purchase of products in your cart if another customer has completed checkout of limited stock products first

10. You will receive an email when your order has been processed

11. Angling Direct reserves, the right to (i) cancel these offers at any time; (ii) cancel or refuse any individual's benefit from it; (iii) amend these terms and conditions

The following general terms and conditions apply to your use of the website in general (Part A) and to all contracts concluded between you and Angling Direct NL B.V. via the website www.anglingdirect.eu, and at the same time contain statutory information on the rights of the customer under the regulations on contracts at a distance and in electronic commerce (Part B).

Angling Direct NL B.V. is a company incorporated in England & Wales, with company no. KVK 863029607 (“Angling Direct, “We”, “Our”). Our registered office is at: Angling Direct NL B.V., Dirk Hartogweg 14 DC1 Unit 5, 5928 LV, Venlo.

By using our site, you confirm that you agree to the above terms and conditions (together "the Terms and Conditions") and that you will comply with them. If you do not agree to these Terms and Conditions, you may not use our Site.

Part A – Term of Use

1. Changes to these Terms and the Site

We change these Terms from time to time. So whenever you wish to use our site, please review these terms and make sure you understand the terms that apply.

We occasionally update our site because our products or user needs have changed.

2. Access to the page

We cannot guarantee that our site or any content on it will always be available or that your use will be uninterrupted. We may suspend, withdraw or limit the availability of all or part of the Site for business or other reasons. We will endeavor to give you reasonable notice of unavailability.

3. Information during user registration

Users can set up an account on the site, which allows them to view and track their orders in their accounts. With an account, the payment process is faster, several shipping addresses can be stored and it opens up various other options. Account holders are typically required to establish a user identifier and password. You must keep this information confidential and not disclose it to anyone else.

We may disable your user identification and password at any time, whether you have chosen us or we have good reason to believe that you have failed to comply with these Terms of Use. You remain responsible for all consequences of the use and misuse of your login information. All instructions and actions submitted through the Site are deemed to have been taken by you using your username and password.

If you know or suspect that someone else has used your user identification or password, you must contact us immediately at support@anglingdirect.eu

4. How You May Use Materials on Our Site

We either own or license the intellectual property in our site and the materials published on it. These items are protected by copyright laws and treaties around the world. All these rights are reserved. You may not use any part of the content on our site for commercial purposes without a license from us or our licensors.

5. Rules for Linking to Our Site

You may link to our site, provided you do so appropriately, and legally, and do not damage our reputation or take advantage of it. You must not post any link that suggests any affiliation, approval, or endorsement on our part where we do not have it.

You must not provide a link to our site from a website that is not owned by you.

We reserve the right to withdraw linking permission without further notice.

6. Our liability for loss and damage suffered by you

The following exclusions and limitations of liability apply to our liability for damages due to your use of our website, notwithstanding the other statutory requirements.

We have unlimited liability if the cause of the damage is due to intent or gross negligence.

Furthermore, we are liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which you regularly rely (so-called. cardinal duties). In this case, however, we are only liable for the foreseeable, contract-typical damage. Subject to the following paragraphs, we are not liable for the simple negligent breach of obligations other than those specified in the preceding sentences.

The above limitations of liability do not apply in the event of injury to life, limb, or health, for a defect after the assumption of a guarantee for the quality of the product, and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

Insofar as our liability is excluded or limited, this also applies to the personal liability of our employees, representatives, and vicarious agents.

Several disclaimers and limitations of liability apply to the supply of Products to you and are set out in our Terms of Delivery (see Part B below).

7. Upload content to our site

The content you upload to our site, including product reviews, is not confidential or proprietary. You retain ownership of the content, but you must give us a license to use, store and copy that content and that we may distribute and make the content available to third parties.

We may also disclose your identity to a third party if the third party claims that any content you have posted or uploaded to our site violates its intellectual property or privacy rights.

We may remove any posting you have made on our site if, in our opinion, it does not meet our content standards.

8. The security of our site

You are responsible for the settings of your information technology, computer programs, and the platform from which you access our site. You should use your own anti-virus program.

You must not misuse our site by knowingly introducing viruses, trojan horses, logic bombs, or other material which is malicious or technologically harmful. You must not gain unauthorized access to our site, the server on which the site is located, or any server, computer, or database connected to our site. You may not attack our site with denial-of-service attacks or forwarded denial-of-service attacks. Breach of these provisions is a criminal offense under the Computer Misuse Act 1990 and we will report any breach of the law to law enforcement agencies and we will cooperate with those agencies by disclosing your identity. If there is such a breach, you must stop using our site immediately.

9. Governing Law and Venue

The law of the Federal Republic of Germany applies exclusively, excluding UN sales law. The legal regulations on the limitation of the choice of law and the applicability of mandatory regulations, in particular of the state in which you as a consumer have your habitual residence, remain unaffected. The place of jurisdiction and performance is our registered office if you are a merchant, a legal entity under public law, or a special fund under public law.

10. Our trademarks are registered

"ADVANTA", "ECLIPSE" and "TOTAL ECLIPSE" are registered trademarks of Angling Direct plc or J.Simpson (Angling) Limited (a company within our group of companies). You may use them only with our permission.

Part B - Terms of Delivery

1. The Terms

The following terms of delivery apply to all contracts concluded between you and us via the website www.anglingdirect.de and at the same time contain legal information on your rights under the provisions on contracts in distance selling and electronic commerce.

2. Conclusion of contract, the contractual partner

2.1. The contract is concluded by completing the ordering process, which we will inform you about below.

2.2. You can select products from our range without obligation and collect them in a so-called shopping cart by clicking the "Add to cart" button. You can then proceed to complete the order process within the shopping basket by clicking on the "Proceed to checkout" button. Here you have to enter all the required data in the fields provided. By clicking on the "Buy now" button, you make a binding request to purchase the goods in the shopping basket. Before sending the order, you can check the data again and change them at any time. Required information is marked with an asterisk (*). When you place an order on the site, we will confirm your order by sending an e-mail to the e-mail address you have given us. Please note that the order confirmation is not yet an acceptance of the order. We will assign an order number for you and let you know when we have accepted your order. This allows you to track your order in your account. A contract of sale with us for our products is only concluded when we expressly accept your order.

2.3. Your order is accepted and the contract is formed when you either receive acknowledgment of our acceptance of your order or, failing that when we despatch the goods to you.

2.4. If we are unable to accept your order, we will let you know and we will not charge you for the products. This may occur when the product is out of stock because of limited resources and could not reasonably have predicted this, because we have discovered an error in the price or description of the product, or because we are unable to meet a delivery time that you have specified could not comply.

3. Our products and payments

3.1. Images on our site are for illustrative purposes only, so our products may vary slightly.

3.2. Materials and textures are only approximations and may appear different on each computer. The packaging of the products may differ from that shown on the site.

3.3. We may run special promotions or offers for our products at any time. These special conditions then apply to these special promotions and offers.

3.4. The price on the website includes the statutory Value Added Tax, but does not include shipping costs.

3.5. We use Sage Pay, Amazon, and PayPal Express as our service providers for payments. We accept both Mastercard, and Visa debit cards and credit cards. Customers using PayPal can also pay directly from their PayPal account.

3.6. You can also pay for our products on our site with our gift vouchers. Our gift vouchers are valid for at least 36 months from the end of the year in which the voucher was purchased. During the payment process, you will be asked to enter the 16-digit number on the back of your card. Once you have entered the gift card code, your order balance will automatically be credited with the value of the gift card.

3.7. If there is a difference to be paid, you can use our normal payment service providers (as listed in clause 3.5.) in the usual way. If you have not used the entire value of the gift card(s), the remainder of the balance on the gift card will remain and you can use it another time.

4. Deliveries

4.1. You can see the shipping costs and the estimated delivery times here on our site. Please note that shipping costs may change from time to time.

4.2. We will either deliver the products to the address you gave when ordering or to the address given in your account, depending on what you choose. The delivery time is indicated for each product on the product page.

4.3. You also have the option of giving us special delivery instructions. We will use our best reasonable endeavors to deliver our products safely and in accordance with your specific delivery instructions, but we shall not be liable for any delay, damage or loss resulting from your compliance with those specific instructions.

4.4. If our delivery of the Products is delayed due to an event beyond our control, we will notify you as soon as possible and will try to minimize the impact of the delay.

4.5. If not all ordered products are in stock and this is expressly stated in the respective item description, we are entitled to make partial deliveries at our expense, insofar as this is reasonable for you. The parts of the order that are available at a later date will be delivered to you within the delivery time stated on the respective article page. If there are unforeseen delivery delays for some of the goods that are not mentioned in the item description, we will inform you of this immediately. In this case, you are free to withdraw from the contract or agree to one or more partial deliveries.

5. Cancellation policy

As a consumer, you have a statutory right of withdrawal when concluding a distance selling transaction, about which we will inform you below in accordance with the statutory model.

Right of withdrawal

You have the right to revoke this contract within fourteen days without giving reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. In order to exercise your right of withdrawal, you must tell us

by means of a clear statement (e.g. a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but it is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding the exercise of the right of cancellation before the cancellation period has expired.

Consequences of Revocation

If you revoke this contract, we have paid you all payments that we have received from you, including delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheap standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Furthermore, the right of cancellation does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

7. Our liability for loss and damage suffered by you

The following exclusions and limitations of liability apply to our liability for damages, notwithstanding the other legal requirements for entitlement.

We have unlimited liability if the cause of the damage is due to intent or gross negligence.

Insofar as our liability is excluded or limited, this also applies to the personal liability of our employees, representatives, and vicarious agents.

8. Other Important Provisions

8.1. We may transfer this Agreement to someone else. We may transfer our rights and obligations under these Terms to another organization. We will notify you in writing if necessary and we will ensure that this transfer does not affect your rights under the contract.

8.2. No one else has any rights under this contract. This contract is between you and us. No one else can enforce its terms.

8.3. Even if we delay in enforcing this Agreement, it will not prevent us from enforcing it at a later date. If we don't insist immediately on something you are required to do under this contract, or if we delay in taking action against you for breaking the contract, that doesn't mean you don't have to do it and we can still take action later initiate against you. For example, if you don't make a payment and we won't contact you about it, but deliver the products to you, we can still ask you to make the payment later.

8.4. Governing Law and Jurisdiction. The law of the Federal Republic of Germany applies exclusively, excluding the UN sales law. The legal regulations on the restriction of the choice of law and the applicability of mandatory regulations, in particular of the state in which you as a consumer have your habitual residence, remain unaffected.

Jurisdiction and place of performance is our registered office if you are a merchant, a legal entity under public law, or a special fund under public law..

Promotional Code Terms and Conditions

Unless otherwise stated, promotional codes apply only to orders placed online.

Promotion codes entitle you to a saving on a new order with Angling Direct at the time of order.

Angling Direct reserves the right to refuse any order not covered by the promotional code. Promotional codes are only valid for specific products, only while stocks last, and can be withdrawn at any time.

They do not apply to finance transactions and transactions, shipping costs, and purchases made with gift cards.

Promotion codes are not valid in conjunction with any other promotion. The offer does not apply to offers in a clearance sale or other reduced goods.

If part of the order is returned, the value of the discount applied to the order will be divided among the goods. The customer will be reimbursed in cash for the sum exceeding this value. If the offer is still valid at the time of return, you must place a new order using the original promotional code.

Free shipping offers apply to standard UK shipping only.

If an item is free or half-price when purchasing multiple items, the discount will only apply to the lowest-priced item.

Angling Direct may change these terms and conditions at any time with effect for the future or future contracts.

Promotional codes in brochures only apply to the items mentioned within the brochure as part of the promotion.

Competitions on Facebook

Angling Direct occasionally hosts contests on Facebook. If you would like to participate, simply follow the online instructions at www.facebook.com/anglingdirect. You must comply with the specified entry deadline.

NO PURCHASE IS NECESSARY.

A pricing summary is available online. Full details can be obtained by emailing media@anglingdirect.co.uk with 'Conditions' in the subject line. A person can only participate once. Bulk submissions and submissions from third parties will be excluded. You must be at least 18 years old and a resident of the UK to participate. We reserve the right to substitute the prize for another prize of comparable value.

The winner's name will be posted online at facebook.com/anglingdirect.

Prizes will be drawn at random from all entries. Prizes that require a specific answer will be drawn from all correct entries.

We may use photos, names, and counties of the winners in later publications and PR activities. Angling Direct employees, family members of employees, representatives associated with the company, and anyone associated with the promotion may not participate in this promotion.

E-Gift Card

Visit the website and place the desired products in the shopping cart. Enter the 16-digit code at checkout.

For multiple gift vouchers, please enter one code at a time. If the purchase value is higher than your credit on the gift voucher, you can easily pay the difference with your EC or credit card.

If you do not use the full value of your card, the difference remains on the card as a credit and only expires after 24 months. No more credit can be added after the card has expired.

You also have the option to add the value of the gift certificate as a credit to your Angling Direct account. To do this, please log in (My Account), open the Ge gift voucher page, click 'Redeem' and enter your 16-digit code.

If you need to return a product that you bought with your voucher, we'll put the value back on your card and you can use it on your next purchase.

The voucher value cannot be exchanged for cash and can only be used online at Angling Direct.
